Terms and Conditions of Sale

1. Scope of Application

These TOS apply to any order placed on https://vps1dollar.com or through the commercial service of VPS1Dollar.

Validation of any order or payment constitutes full acceptance of these terms, the current pricing, and any specific conditions attached to a particular offer.

VPS1Dollar reserves the right to modify these TOS at any time, notably to comply with applicable laws or improve the service. New provisions will automatically apply to ongoing contracts after prior notice by e-mail.

2. Orders and Validation

An order becomes effective once the payment is successfully validated by the secure payment provider (Stripe) and automatically confirmed by e-mail.

Each VPS is deployed automatically upon payment confirmation, except in cases of anti-fraud checks or technical inconsistencies requiring manual verification. In such cases, proof of identity or payment may be requested.

No service will be provisioned until payment is confirmed. Any false declaration may result in immediate cancellation without refund.

3. Pricing, Billing, and Renewal

Prices are shown in euros (?) excluding taxes unless otherwise stated. The total amount including taxes is displayed before payment and on each invoice.

Services are billed monthly and renewed automatically on the due date unless canceled explicitly through the client area before the renewal date.

The client may cancel a service at any time from their client area. The current month remains fully due; no partial refunds are granted for periods already started.

In case of a price change, the client will be notified at least 15 days before it takes effect. They may then cancel the service without penalty before the new rate applies.

4. Payment and Security

Payments are processed exclusively by credit or debit card via Stripe?s secure platform, PCI-DSS certified. No banking data is stored or retained by VPS1Dollar.

In case of failure, rejection, or late payment, an automatic reminder e-mail will be sent. If the payment is not settled within 5 days, the service may be suspended and then deleted after 7 additional days.

Payments are considered final once fully validated by Stripe. Any abusive chargeback attempt will result in the immediate termination of all related services.

5. Delivery and Service Activation

VPS instances are created and configured automatically after payment validation. A confirmation e-mail containing login credentials is sent to the registered address.

The average provisioning time is under 5 minutes, except in exceptional cases (hardware issue, overload, or anti-fraud review).

The service is deemed delivered as soon as the VPS access credentials are sent, even if the client has not yet logged in.

6. Right of Withdrawal

Under Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully executed before the legal period expires or customized according to the client?s specifications.

By confirming payment and requesting immediate activation of the VPS, the client expressly waives their right of withdrawal.

7. Liability and Warranty Limitations

VPS1Dollar is bound by an obligation of means, not of result. The company uses all reasonable efforts to ensure availability, security, and performance of its services.

The liability of VPS1Dollar shall not be engaged in cases of temporary maintenance downtime, external incidents (DDoS attacks, power outages, network failures, disasters), or client misconduct.

The client is solely responsible for hosted content, installed software, and configurations. The client shall hold VPS1Dollar harmless from any third-party claims related to such content.

8. Data and Backups

The client is responsible for their data and must ensure their own backups, even when a dedicated FTP backup space is provided.

Included or optional FTP backup storage is strictly limited to VPS data backups hosted with VPS1Dollar. Any other use (personal storage, public sharing, illegal content, etc.) is strictly prohibited.

VPS1Dollar reserves the right to suspend or delete any backup space that violates this policy, and may terminate the client account in case of repeated abuse.

No guarantee is provided for data recovery after termination, deletion, or technical incident beyond our control.

9. Suspension and Termination

VPS1Dollar reserves the right to suspend or terminate a service or an entire client account in cases of:

- non-payment after reminder;

- serious breach of TOS/GTU;

- abusive use of resources (CPU, storage, bandwidth, VLAN, FTP);

- illegal or infrastructure-compromising activities.

Suspension may occur immediately without prior notice in case of security threats or unlawful use. Reactivation may be considered after issue resolution or account review.

10. Support and Technical Assistance

Technical support is available 24/7 by e-mail or ticket through the client area.

Tickets are handled based on priority: critical incidents affecting service availability receive top priority.

Support does not include issues related to client-side software configuration (websites, CMS, custom code, databases), except for commercial or goodwill assistance.

11. Force Majeure and External Interruptions

Neither party shall be held liable for failure to perform due to force majeure (natural disasters, war, major power failure, large-scale network outage, etc.).

In case of prolonged force majeure, the contract may be suspended or terminated without compensation.

12. Personal Data and GDPR Compliance

Collected data (name, e-mail, IP address, connection logs, billing info) are processed solely for service management, billing, and security purposes.

No personal data is sold or transferred to unauthorized third parties. Payments are managed by Stripe, which applies PCI-DSS standards.

In accordance with GDPR (EU Regulation 2016/679), clients may exercise their rights of access, rectification, or deletion of their data by contacting [email protected].

13. Governing Law and Dispute Resolution

These TOS are governed by French law. Any unresolved dispute shall be submitted exclusively to the competent courts within the jurisdiction of VPS1Dollar headquarters.

In case of translation, only the French version shall prevail in the event of interpretation discrepancies.
