Terms of Service and Privacy Policy

1. Purpose and Scope

These Terms define the rights and obligations of both VPS1Dollar and any customer using its VPS hosting services, including associated options such as private VLANs, FTP backups, or snapshots.

Any subscription, order, or use of the service constitutes full acceptance of these Terms of Service.

The Terms may be modified at any time to reflect legal, technical, or commercial changes. Any significant modification will be communicated to customers by e-mail or through the client area with reasonable notice.

2. Account Creation and Customer Obligations

Creating an account requires verifiable identity information, a valid e-mail address, and accurate contact details. Customers must keep this information up to date at all times.

The customer is responsible for maintaining the confidentiality of their credentials. Any action performed through the account is presumed to originate from the customer unless a security breach has been previously reported to [email protected].

Providing false information or creating multiple accounts to bypass limits or suspensions is strictly prohibited.

3. Acceptable Use of Services

VPS services provided by VPS1Dollar must be used for lawful purposes and in compliance with French and European regulations.

The following activities are strictly prohibited:

- Sending spam or unsolicited e-mails;

- Hosting illegal content (child exploitation, hate speech, hacking tools, copyright infringement, etc.);

- Cryptocurrency mining without prior written authorization;

- Hosting public proxy, public VPN, seedbox, or open relay services;

- Performing network attacks (DDoS, brute-force, port scanning);

- Any action that may compromise the stability or security of the network or other customers.

Any abuse may result in immediate suspension of the service or the entire account, without notice or refund.

4. Backups and Dedicated FTP Space

Each VPS includes a dedicated FTP backup space accessible through a private VLAN. This space is strictly reserved for storing backups of data hosted on VPS servers provided by VPS1Dollar.

Any other use (personal storage, streaming, file sharing, public or illegal hosting) is strictly prohibited.

In case of misuse or non-compliance, VPS1Dollar reserves the right to suspend or delete access to the FTP space, or to terminate the entire service.

The customer remains responsible for verifying and maintaining the integrity of their backups. VPS1Dollar does not guarantee data recovery in the event of deletion or corruption.

5. Availability, Maintenance, and Performance

VPS1Dollar commits to maintaining an average service uptime above 99.9%. Scheduled maintenance may be necessary to ensure infrastructure security and performance.

In the event of a critical incident, the technical team operates 24/7 to restore services as quickly as possible.

Performance depends on the allocated resources and the client?s configuration. Temporary limitations may be applied to preserve the stability of the shared infrastructure.

6. Security and Customer Responsibility

The customer is responsible for the content, software, and configuration of their VPS. They must maintain an appropriate level of security (regular updates, strong passwords, firewalls, etc.).

VPS1Dollar cannot be held liable for misconfiguration, hacking, data loss, or improper service usage.

In the event of an attack, malware infection, or compromise affecting the infrastructure, the affected VPS may be isolated or suspended without prior notice.

7. Billing and Payments

Services are billed monthly with no long-term commitment. Payment is due on the date specified in the client area.

In case of non-payment, the service will be suspended after 48 hours and permanently deleted after 7 days if payment is not received.

Payments are securely processed via Stripe. No banking information is stored on VPS1Dollar servers.

8. Technical Limits and Resource Usage

VPS instances are hosted on shared infrastructure using container-based virtualization. As such, they do not provide full operating system or kernel-level control.

Certain system-level features, configurations, or software may be unavailable or restricted by design and cannot be enabled on request. These inherent technical limitations do not constitute a defect of service.

Certain networking features requiring low-level access to the operating system or kernel (including the activation of network modules, use of specific system devices, creation of system-level network tunnels, or operation of VPN services relying on such mechanisms) are not supported on VPS instances and cannot be enabled or unlocked, even upon request.

Excessive or abusive use of system resources (CPU, I/O, bandwidth) is prohibited.

In case of overuse or service degradation, VPS1Dollar may apply temporary limitations or propose an upgraded plan better suited to the client’s needs.

Upgrade options (CPU, RAM, storage, VLAN, bandwidth, snapshots, etc.) may be applied upon request to improve performance with minimal downtime.

9. Suspension and Termination

VPS1Dollar may suspend or terminate an entire client account in the following cases:

- Violation of these Terms of Service;

- Repeated payment defaults;

- Excessive or abusive use of resources, bandwidth, or FTP space;

- Attempts to exploit or interfere with system vulnerabilities;

- Detection of illegal activity.

Immediate suspension may occur if a verified threat to infrastructure or other customers is identified.

10. Support and Assistance

Technical support is available via ticket or by e-mail at [email protected].

Tickets are handled based on priority level, with a target response time of under 4 hours for critical incidents.

Abusive or disrespectful behavior toward support staff may result in account suspension.

11. Personal Data and Privacy (GDPR)

VPS1Dollar collects only the information necessary for account creation and service management: name, e-mail address, IP address, technical logs, and billing data.

This information is used exclusively for billing, service management, security, and customer support purposes. No personal data is sold, transferred, or shared with unauthorized third parties.

Technical logs (connections, IP addresses, events) are retained for up to 12 months for legal and security reasons.

In accordance with the EU General Data Protection Regulation (GDPR - EU 2016/679), you have the right to access, correct, or delete your personal data. To exercise this right, contact [email protected].

Payments are processed through Stripe, which is solely responsible for handling payment data under its own privacy policy (PCI-DSS certified).

12. Cookies and Analytics

This website uses essential technical cookies required for proper operation (authentication, language, cart).

Analytical cookies may be used to improve site performance. You can disable them in your browser settings.

No browsing data is sold or used for commercial profiling purposes.

13. Governing Law and Jurisdiction

These Terms are governed by French law. In case of a dispute, the competent courts are those within the jurisdiction of VPS1Dollar's registered office.

In the event of a discrepancy between the French version and a translation, the French version shall prevail.
